The rental of all the properties on the website
www.curtiaffitti.com
 and contained in the catalog has the legal nature of “Tourist Lease” and is concluded by CURTI COSTRUZIONI SRL, owner of the real estate, according to the prices advertised on the website. Since these are private houses for vacation use, they do not have internationally recognized standards or categories; rather, they reflect local traditions and the owner’s personal taste in their architecture and decor.

1) LEASE PERIOD

CURTI COSTRUZIONI SRL offers its properties for weekly rentals, for up to 4 consecutive weeks in favor of the same client. Short stays, or with arrivals and departures on days other than Saturday, will be possible in low and mid-season. Facilities classified as “private” are generally rentable only at certain times of the year.

2) BANK TRANSFER BOOKING PROCEDURE

Upon receipt of the reservation request by bank transfer (via website/e-mail/phone) and having ascertained the availability of the facility for the selected period, CURTI COSTRUZIONI SRL will reserve it in favor of the clients, sending (via e-mail) the confirmation of the reservation with the necessary bank details for making the required payment. The reservation will be considered confirmed only upon receipt of credit within the stipulated time and copy of the bank transfer made.

Through payment by credit card, booking confirmation will be immediate.

For undated reservations (within 60 days of arrival), reservations must be made directly, which is considered binding and in any case always validated by the copy of the bank transfer made by the due date, and confirmed upon receipt of the same.

Reservation requests by bank transfer, if not confirmed by the customer by the communicated due date and time, will be automatically cancelled by the system. The property, therefore, will again be free and bookable online.

3) ONLINE BOOKING PROCEDURE

Facilities on the CURTI COSTRUZIONI SRL website can be booked directly online by proceeding to pay the required deposit by Credit Card. In this case, the reservation will be effective from the moment the organizer accepts the payment and sends the receipt/invoice for the same.

Upon acceptance of the option or reservation, customers will receive from CURTI COSTRUZIONI SRL (via e-mail) the reservation form containing, amounts and due dates of the different payments (DEPOSIT/SALID), payment conditions in addition to the general reservation conditions.

4) RESERVATIONS MADE LESS THAN 60 DD. FROM THE BEGINNING OF THE STAY

For bookings made less than 60 days before the start of the stay, customers must make payment of the full rental amount in one lump sum at the time of booking. The payment methods to be followed are the same as those adopted in the normal booking procedure.

5) PAYMENT TERMS VALID FOR BOOKING OF LEASES WITH A MAXIMUM DURATION OF 4 WEEKS *.

The reservation form contains the amounts and due dates of the various payments useful for making the reservation, as follows and as will be stated in the individual rental agreements: To be paid at the time of reservation: 30% as a DEPOSIT calculated on the rental price from the price list

To be paid within 29 days before the start of the lease: 70% as BALANCE to be paid by bank transfer or credit card.

Upon receipt of the down payment CURTI COSTRUZIONI SRL will forward, via email:

– Confirmation of reservation;

Upon receipt of the balance, CURTI COSTRUZIONI SRL will forward, via e-mail, the reservation documents:

– Directions to the booked property;

– Check-in Instructions

NB: However, payments for reservations will be settled and accepted only and exclusively in EURO currency.

A cumulative invoice of all amounts paid, will be emailed to the customer within 15 working days from the date of check-out.

*Except for special booking terms, specified at the time of booking.

6) CANCELLATION COMMUNICATION

This contract in accordance with Article 32 of the Tourism Code does not provide for the right of withdrawal referred to in Legislative Decree September 6, 2005, no. 206 for contracts concluded at a distance. However, cancellation of the reservation is allowed, which must be received on working days (Monday through Friday from 09:00 to 19:00) prior to arrival and does not include the day of arrival and the day of the communication itself. 7) CANCELLATIONS VALID FOR RESERVATIONS OF LEASES WITH A MAXIMUM DURATION OF 4 WEEKS

Cancellation of a reservation, even if it is replaced by another one, will incur the following penalties:

30% of the total reservation price (rental price related to the booked period) in case of cancellation of reservation communicated 45 days before the beginning of the stay;

50% of the total reservation price (rental price related to the booked period) in case of reservation cancellation communicated between the 45th and 30th day from the beginning of the stay;

100% of the total reservation price (rental price related to the booked period) in case of reservation cancellation communicated between the 29th day and the start date of the stay;

8) CONDITIONS and TERMS OF PAYMENT VALID FOR RESERVATIONS OF RENTAL DURATION LONGER THAN 4 WEEKS.

For leases longer than 4 weeks, where possible, payment and cancellation terms as well as security deposits will be subject to changes that will be communicated at the time of booking with the relevant documentation.

Prior to the final confirmation of the reservation, for stays of such duration, the customer can make, upon request, an inspection at the villa of his or her interest, unless the same is rented to other guests and subject to the availability of the owner. The customer is always required to read carefully and attentively property descriptions, prices, and technical information described on the site. Clients may also request from booking agents the floor plan of the property or any additional information of their interest not included on the pages of our website.

9) EXTRA SERVICES AND COSTS

In the tabs of each property, in the pricing section, it is clearly stated what the rental price includes or does not include. Ancillary services such as intermediate cleaning services or linen change (where possible to carry out such services) are on request and can be arranged at the time of booking After that time confirmation is subject to availability of the supplier.

Use of heating and air conditioning: regarding temperatures and period of use, is governed by regulations that vary from region to region. In general, heating systems can be used from November to April, for a maximum of 8 hours per day, and air conditioning systems during the summer months. (Regulations about on-time, off-time, temperature vary from region to region). Clients must strictly abide by these rules.

Internet connection: the owner of facilities where an internet connection is provided is not liable for any malfunctions caused by technical problems and/or for network issues beyond his or her control or good behavior.

In the event of malfunctions, the owners will do everything possible to remedy the inconvenience, but the company intends to point out that some connections may not be suitable for work requiring excessive megabyte usage or offloading anyway, and that simultaneous connection of multiple devices may cause general line slowdowns.

Electric car recharging: recharging of electric cars is allowed at the designated pick-up point, the per-shot cost of which will be indicated in the specific sheet of each property.

10) ARRIVAL AND DEPARTURE TIME

On arrival and departure days, scheduled arrival times are between 4 p.m. and 7 p.m.

It is recommended that the client notify at least one week in advance of the start of the stay of the arrival time so that the owner or his representative can be on site to wait for the client and facilitate entry at the facility. Such communication may be made through our contacts on the website

Departure from the property must take place in the morning by 10 a.m., allowing access to the owner to check the condition of the property and to the cleaning staff to tidy up the house at least one hour before the notified departure time. However, the time of departure must always be communicated at least 12 hours in advance to the owner or property manager.

11) ARRIVAL AT THE PROPERTY

Upon arrival at the facility, guests are asked to present identification (passport or ID card) to the owner or his representative for registration of attendance as required by Italian law. Without these documents, access to the property cannot be granted.

12) SECURITY DEPOSIT

Upon check-in, Curti Costruzioni SRL will require the payment of a deposit, the amount of which will be specifically stated in the accommodation description sheet. This amount may only be paid by escrow credit card deposit.

This sum, will be retained by Curti Costruzioni SRL until the end of the stay and returned within 24 hours of check out, subject to the presence of damage to the property, minus the extra costs for services that guests will have enjoyed.

13) NUMBER OF GUESTS AND THEIR IDENTIFICATION

At the time of booking, clients will be required to enter the names and ages of the people who will be staying at the property. Each property’s file, both on the web and in the catalog, lists a maximum number of people the property can accommodate. This number (adults – children – infants) cannot be exceeded in any way. In the event of alterations in the number of persons present or in the arrangement of rooms on arrival, the owner who has not been previously informed and who has not agreed to any changes will not be held to them. Should it be in its power to accommodate customers, they will still be obliged to pay the required surcharges.

Villa Events: Only some properties are suitable for hosting events which must, in any case, be authorized in advance by the property.

14) CHILDREN 0-24 months

CURTI COSTRUZIONI SRL will be happy to provide cribs, cribs and high chairs for children. In most facilities this is a service that is offered free of charge. The company asks you to notify the number of cribs required at the time of booking, and in any case at least 30 days before your arrival. Children who fall under this designation are “infants” who have not yet turned 3 years old.

15) ANIMALS.

Animals are not allowed inside the properties.

16) CLEANING THE PROPERTY

The cost of final cleaning of the property is not included in the rental price, and will be made explicit on the individual. Weekly cleaning (applicable on lodging facilities only) does not include kitchen cleaning and garbage disposal.

The properties shall be returned in good hygienic condition in all their parts and accessories. Otherwise, the customer will have to pay the owner or his representative an additional cost necessary for cleaning. It is the customer’s responsibility to take care of waste disposal.

Where guests do not dispose of waste from the property, the owner or his delegate may charge an additional fee of €100 for this service. The kitchen should be left in good hygienic condition and tidy as far as possible. If, for any reason, including time, guests are unable to clean the kitchen and furnishings before their departure, the owner will be entitled to charge an additional €100 for cleaning it.

17) POOL AND PARK MAINTENANCE

Pools will be open during the periods indicated in each property’s information (off-season openings will also be governed by weather conditions). Any openings outside the specified period must be arranged with the owner and will require payment of an additional fee for the use of heating.

There is a daily charge for requesting activation of the pool heater indicated in the relevant reservation form.

Gardeners and property managers in general are constantly working hard in order to keep the park in excellent condition (with green and regularly watered lawns, grass cut, flowers tended, etc.). However, it should be pointed out that the state of the lawns on the properties may not conform to the photos posted on the website in case of periods of severe and prolonged drought and/or if there are municipal/governmental ordinances rationalizing or preventing the consumption of water for irrigation uses. In this case CURTI COSTRUZIONI SRL cannot be held responsible for any deteriorating state of the gardens.

18) MAINTENANCE AND EXCEPTIONAL OPERATIONS

In the case of maintenance or exceptional work that is essential for the peaceful conduct of the vacation, the clients shall not under any circumstances prohibit the owners or managers of the facilities from entering the property or dwelling. It is understood that the owners will always provide advance notice and request the presence of the guests themselves, it being understood that where guests cannot be present during the course of the work, the owners or their agents may still enter the homes, if necessary, to carry out any repair work.

18) TOURIST TAX

According to the provisions stipulated in Art. 4 of Legislative Decree no. 23 of March 14, 2011) Italian municipalities with a predominantly tourist vocation can apply for the tourist tax, which is intended to finance tourism-related interventions including those in support of accommodation facilities, maintenance, enjoyment and recovery of cultural and environmental assets, and local public services. The tax is levied per overnight stay (i.e., per person and per night), and the amounts (generally between €0.50 and €5.00 per person per night) are set by the municipality to which the booked property belongs; there may be possible exemptions (such as for children under 14 years of age, handicapped persons, etc.). The tax, if provided by the municipality of the property, must be paid on site.

20) BEHAVIORAL STANDARDS

Guests are kindly requested to observe the current behavioral norms in our country regarding good manners and to show the utmost respect to the owner and the facility where they are staying. Therefore, it is strictly forbidden to move furniture inside the dwelling, take furniture and interior furnishings outside the dwelling, and/or put them to any use other than their intended use. In the event that a guest fails to comply with the rules of good behavior and these are the basis of damage caused to the property or the furnishings therein or the supplies outside the home with regard to the garden and swimming pool, the owner shall have the right, in his sole discretion, to deem the rental agreement terminated by verbal notice to the guest and in writing and request the immediate removal of the guest from the property with the right to use public force as well.

21) CIVIL AND GENERAL LIABILITY

In accordance with Italian and European Community Law on guarantees for customers in the tourism industry and Regional Law no. 16 of 08/02/1994, CURTI COSTRUZIONI SRL has taken out appropriate insurance policy for risks arising from civil liability to clients, as provided for in Article 38, Paragraph 10 of Regional Law No. 27/2015.

22) PERSONAL DATA PROCESSING

Personal data and any other element learned by CURTI COSTRUZIONI SRL in the course of carrying out the assignment, will be subject to secrecy and will be treated with respect for the confidentiality and rights of the person through the systematic application of appropriate protection and guarantee measures prepared for both paper and electronic data processing and measured to the specificity of the data itself (simple personal data or sensitive or judicial data). Pursuant to and in accordance with REG. EU 679/2016 you are informed that your personal data will be processed only for the purposes determined by the contractual relationship for these purposes (including accounting and administrative purposes). These data could be used for commercial and promotional activities related to the services provided by CURTI COSTRUZIONI SRL, for the latter use a consent to the processing is required. Lack of consent from the Customer will not allow the Company to use the personal data to carry out business activities.
